Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and SkillSpoof ("we," "us," or "our"). By accessing or using our gaming automation platform, software, website, or related services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use our Services.

2. Description of Services

SkillSpoof provides gaming automation software and related services designed to enhance gaming experiences through legitimate automation tools. Our Services include software applications, web-based dashboard, API access, Discord community, documentation, and customer support.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to use our Services. By using our Services, you represent that you meet this age requirement.

3.2 Account Registration

To access our Services, you must create an account through Discord OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Account Restrictions

• One account per person
• No account sharing, selling, or transferring
• You must provide a valid Discord account for authentication
• You must provide accurate registration information

3.4 Inactive Account Removal

Accounts that remain inactive for 3 months or more will be permanently deleted without prior notice. An account is considered inactive if no login activity is recorded within the specified period. All associated data, including subscription history and uploaded scripts, will be permanently removed and cannot be recovered.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use our Services for:

• Personal gaming automation within the scope of our software capabilities
• Accessing the web dashboard and documentation
• Participating in our Discord community
• Developing custom scripts using our API and LUA scripting engine
• Sharing scripts within the platform (subject to our guidelines)

4.2 Prohibited Activities - INSTANT BAN OFFENSES

The following violations result in immediate permanent account termination without warning:

• Content Leaking: Sharing, distributing, or exposing any content from private Discord channels, premium areas, or restricted sections to unauthorized persons or public platforms
• File Distribution: Sharing, uploading, redistributing, or providing access to our software files, modules, or proprietary content to third parties
• Reverse Engineering: Attempting to decompile, disassemble, or reverse engineer our software
• Account Sharing: Allowing others to access your account or accessing others' accounts
• Commercial Redistribution: Selling, reselling, or monetizing access to our Services or content without explicit permission

4.3 Other Prohibited Activities

You also agree NOT to:

• Use our Services for any illegal purposes
• Use our Services to harm, threaten, or harass others in our Discord community
• Attempt to gain unauthorized access to our systems or other user accounts
• Create derivative works based on our software
• Remove or alter any proprietary notices on our software
• Violate Discord's Terms of Service or Community Guidelines
• Violate any applicable laws or regulations

4.4 Zero Tolerance Policy

We maintain a zero tolerance policy for violations listed in Section 4.2. There are no warnings, appeals, or second chances. Violation of these terms results in immediate permanent ban and potential legal action.

5. Content Protection and Privacy

5.1 Confidential Information

All content within private Discord channels, premium areas, and restricted sections is considered confidential and proprietary. Users accessing such content agree to maintain strict confidentiality and not disclose, share, or distribute this information outside the designated platform.

5.2 Screenshots and Documentation

Taking screenshots, recordings, or any form of documentation of private content for external sharing is strictly prohibited and constitutes a violation subject to immediate account termination.

6. Gaming and Third-Party Services

6.1 Third-Party Games

Our Services are designed to interact with third-party games. You acknowledge that:

• We do not own, control, or operate any third-party games
• Use of our Services with third-party games is at your own risk
• You are solely responsible for compliance with third-party game terms of service

6.2 Discord Integration

Our Services integrate with Discord for authentication and community features. By using our Services, you also agree to comply with Discord's Terms of Service and Community Guidelines. We are not responsible for Discord's availability or any changes to Discord's services.

6.3 Account Security Disclaimer

We do not access, store, or handle your gaming account credentials. You are solely responsible for the security of your gaming accounts and any consequences of using automation tools.

7. Intellectual Property

7.1 Our Rights

All rights, title, and interest in our Services, including software, documentation, trademarks, and proprietary content, remain our exclusive property or that of our licensors.

7.2 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal use only.

7.3 User Content

Any content you submit through our Services (uploaded scripts, bug reports, Discord messages in our server, etc.) grants us a non-exclusive license to use, modify, and display such content in connection with operating our Services.

8. Payment Terms

8.1 Subscription Fees

Access to certain Services requires payment of subscription fees. All fees are non-refundable unless otherwise specified or required by applicable law.

8.2 Payment Processing

Payments are processed through secure third-party payment processors. We do not store payment card information.

8.3 Subscription Types

• Monthly Subscription: Automatically renews unless cancelled before the renewal date
• Lifetime License: One-time payment for permanent access to Services
• Activation Codes: Single-use codes that can be redeemed for subscription time

8.4 Device Management and Tokens

Device limits are enforced based on your subscription plan. Removing a device costs tokens as specified in your account dashboard. Tokens can be purchased separately and are non-refundable.

8.5 Refund Policy

• No refunds for monthly subscriptions after activation
• No refunds for lifetime licenses after activation
• Activation codes are non-refundable once revealed
• Tokens are non-refundable and cannot be exchanged for cash

9. Account Termination

9.1 Termination by You

You may terminate your account at any time by contacting our support team through Discord.

9.2 Immediate Termination by Us

We may immediately terminate your account for:

• Any violation listed in Section 4.2 (Instant Ban Offenses)
• Illegal activities
• Security threats to our Services or users
• Violations of Discord's Terms of Service within our community

9.3 Standard Termination

We may suspend or terminate your account for other violations with appropriate notice.

9.4 Effect of Termination

Upon termination, your right to use our Services ceases immediately. We may delete your account data in accordance with our data retention policies. Banned users are permanently prohibited from creating new accounts and will be removed from our Discord server.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

11. Disclaimers and Warranties

11.1 Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or technical issues.

11.2 Software Performance

While we work to ensure software compatibility and performance, we cannot guarantee that our Services will work with all games, systems, or configurations.

11.3 Discord Dependency

Our Services rely on Discord for authentication and community features. We are not responsible for Discord outages, changes to Discord's API, or any issues arising from Discord's services.

11.4 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES.

Our total liability to you for all claims shall not exceed the amount you paid for our Services in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of our Services or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via Discord announcements or through our web dashboard. Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
